Notice is hereby given that the Mayor and Members of Town Council held a Special Work Meeting.  The meeting was held on Wednesday the 22th day of January 2025 at 6:00 pm at the Torrey Town Office, Bay 1 located at 75 E 100 N. Note the agenda may be accelerated or line items may be discussed in any order.

The agenda shall be as follows:

Roll Call: Pat Kearney, Karen Mayne, Mayor Wright, Jordan Pace, Dustin Oyler

Town Business:

Discuss and approve conditional use requirements for Aram’s fourplexes.

A discussion followed addressing a visual and noise barrier between the four-plex property and the neighboring properties. Shallow rooted scrubs along the property line was recommended. Trees with deep roots could be a problem.

Parking was discussed. Aram is considering concrete or some hard surface from the town road into the parking spaces. Dustin requests a surface which will protect the Torrey asphalt road. There should not be parking in the Town easement (town right of way).

Jordan made the motion to require an acceptable parking plan. The plan must be submitted in writing and approved by the town council. The proposal is to include a mitigation plan so that traffic will not break down the shoulder of the town road. Also, a plan to include fencing and noise abatement around the perimeter of the property. Pat Kearney seconded the motion and all council members approved. 

  • Water Ordinance changes that need to be made to define Subdivision water procedure.

Brock Jackson prepared for Mayor Wright a draft resolution addressing a Torrey water connection for a subdivision ordinance.

Mayor Wright said the water connections would be installed as homes are sold. Also, Infrastructure needs to be installed by the developer. No water meter is guaranteed until home construction is committed. The waterline will be installed by the developer. The developer will be responsible for tying their water line into the Torrey water.  Torrey will research obtaining a Statewide Utility License Agreement (SULA) along Highway 12 with the state. Mayor Wright will explore this further.

The subdivider must obtain a written agreement with Torrey Town to proceed to connect to the Torrey water line.

Dustin Oyler began a discussion regarding fines for those who access the inside workings of their water meters. Discussion continued about the fines established  for getting into the meters. Ref. Ordinance 8-1-17 defines responsibility for the costs of damage to the water equipment. Mayor Wright will consult with the attorney. Torrey may charge a fine plus town expenses.

Subdivision question: Torrey Water Ordinance ref: 8-15-D. Discussion was held regarding the ownership of the subdivision water line which is installed by the developer. When does that town ownership of the water line begin? This requires more investigation and discussion.

  • Short-Term Rental Ordinance changes?

Discussion began about the merit selection process. Karen plans to add the question: “Have you applied previously for a short-term license.

Pat Kearney made a motion to create a resolution to place a moratorium on any new application for STR until the ordinance is clarified. Richard Braaten seconded the motion. All council members voted in favor.

  • Discuss a graduated fee for special events to include the seasonal Farmers Market event. This is addressed below.
  • Farmers Market bathrooms

The new Capitol Reef Farmers Market Memorandum of Understanding (MOU) was presented by Pat Kearney.

The market location is proposed to shift to the north end of the park adjacent to the wall. This will create one row of vendors behind the trees, and one row in front of the trees and the music on the west side. The vendors will work with Dustin before  staking of sun protection structures. That would allow more flexibility for positioning. Also, vendors can use electricity and pay $5.00 weekly for the service.

Responsibilities Outlines Section of MOU: In regard to the tier fee system for special event, the Farmers Market proposes that they would trade care of the GarKane bathrooms once a week during the farmers market season in lieu of a fee. The supervision of the cleaning would be Mary Beddingfield-Smith.  Karen will provide Mary with the Pavilion schedule so they will know when there is another event.

Pat Kearney made a motion to accept the MOU with the adjustments, Richard Braaten seconded the motion. The motion passed with 3 yes votes and 1 no vote.

Motion to adjourn: The motion was made by Jordan Pace. Richard Braaten seconded the motion, and all council members voted to adjourn. 7:36pm          ***
